Terms and Conditions:

Welcome to The Travel Foot! Firstly, we thank you for your trust in us, and we will ensure that you have a great travel experience with us with lots of unforgettable memories at the same time; kindly do understand that by booking your trip with us, you agree to the following Terms & Conditions. These guidelines ensure a smooth and enjoyable experience while maintaining transparency about your rights and responsibilities.

1. Booking & Payments terms

1.1 All bookings must be made through The Travel Foot’s official website or office.
1.2 Bookings are confirmed with 30% advance of the Invoice Amount, and the remaining 70% of the payment should be cleared 15 days before your Trip date.
1.3 A non-refundable deposit (percentage varies by trip) is required to secure your booking.
1.4 Failure to make timely payments may result in cancellation without a refund.

2. Price Adjustments & Extra Charges

2.1 Prices are based on current transportation, accommodations, and service rates. Any significant rise in costs (such as fuel surcharges, accommodation fees, or third-party charges imposed by local unions or government authorities) will be passed on to the traveller.
2.2 All quoted prices are based on the prevailing Indian tax framework. Any new taxes or tax increases imposed by authorities will lead to additional charges, for which travellers will be liable.

3. Cancellation & Refund Policy

Planning an outdoor trip is always filled with excitement and anticipation. However, cancellations can be disappointing. We at The Travel Foot handle all ground operations meticulously, making your travel cancellations from our end extremely rare. Our cancellation policy is designed to be fair and feasible, ensuring that you are not left in a difficult situation. That said, unforeseen circumstances such as extreme weather conditions, government regulations, or other factors beyond the control of THE TRAVEL FOOT may lead to cancellations. If a trek is cancelled by the participant or due to uncontrollable external factors, the following cancellation policy will apply.

General Guidelines for Cancellations:

  • To ensure a smooth experience, we recommend booking your trip at least two months in advance. We are committed to providing you with a seamless booking process and a memorable travel experience. Any cancellation request must be sent to us in writing via email.
  • Cancellation charges are based on the date we receive the cancellation request in writing.
  • Refunds will be issued as a THE TRAVEL FOOT WALLET VOUCHER, which remains valid for12- 24 MONTHS from the issue date, depending on the number of days before you have cancelled the trip.
  • The cancellation policy is structured to cover operational expenses, including permits, accommodations, Transport arrangements, equipment, and logistical costs.

4. Cancellation & Refund (Voucher) Policy

a. Cancellation 30 days or more before the trip start date
– 15% deduction of the invoice amount (covers GST & transaction charges).
– 85% refunded as a THE TRAVEL FOOT WALLET VOUCHER with 24 Months Validity.

b. Cancellation 20-29 days before the trip start date
– 25% deduction of the invoice amount (covers GST, transaction fees, and other cancellations).
-75% refunded as THE TRAVEL FOOT WALLET VOUCHER with 24 Months Validity.

c. Cancellation 15–19 days before the trip start date
– 35% deduction of the invoice amount (covers GST, transaction fees, and other cancellations.)
– 65% refunded as THE TRAVEL FOOT WALLET VOUCHER with 15 Months Validity.

d. Cancellation 10–14 days before the trip start date
-50% deduction of the invoice amount (covers GST, transaction fees, and other cancellations.)
– 50% refunded as THE TRAVEL FOOT WALLET VOUCHER with 15 Months Validity.

e. Cancellation 7–9 days before the trip start date
– 65% deduction of the invoice amount (covers GST, transaction fees, and other cancellations.)
– 35% refunded as THE TRAVEL FOOT WALLET VOUCHER with 12 Months Validity.

f. Cancellation 0–6 days before the trip start date
–  70% deduction of the invoice amount (covers GST, transaction fees, and other cancellations)
–  30% refunded as THE TRAVEL FOOT WALLET VOUCHER with 12 Months Validity.

The Travel Foot strive to provide the fairest and most feasible cancellation policy while ensuring smooth operations. We appreciate your understanding and look forward to making more trips together!

5. THE TRAVEL FOOT WALLET VOUCHER POLICY

The cancellation is processed strictly per The Travel Foot’s cancellation policy when you cancel your trip. A cancellation fee is deducted per the schedule, and the remaining amount is refunded as “The Travel Foot Wallet Voucher.” This voucher is valid for 12 to 24 months, depending on the days before cancellation. It can be redeemed for any trek, tour, or yatra organized by The Travel Foot.

5.1 How Do You Get THE TRAVEL FOOT WALLET VOUCHER?

If you decide to cancel your trip, send an email requesting cancellation. Within 24 working hours, you will receive a response confirming your cancellation along with the voucher details, which will include:

5.2 Terms & Conditions of THE TRAVEL FOOT WALLET VOUCHER

  • The voucher is non-transferable and cannot be reissued or altered once issued.
  • Based on the cancellation policy, validity ranges from 12 to 24 months from the issue date.
  • The voucher can be used for any trek, tour, or yatra organized by The Travel Foot.
  • The voucher can only be used for the same number of persons it was initially issued.
  • Voucher must be used to settle due amount, cannot be redeemed to create a new booking.
  • If you cannot use the voucher personally, you can gift it to a family member.
  • The voucher can be extended beyond its expiry date, subject to a deduction percentage
  • Once the voucher has been redeemed, the respective amount cannot be reissued
  • Email at least 20 days before the trip start date to redeem the voucher.

6.  Itinerary Changes & Unexpected Events

  • 6.1 The Travel Foot is not responsible for itinerary changes caused by natural disasters, landslides, flight/train/bus cancellations or delays, adverse weather conditions, government regulations, strikes, pandemics, political unrest, or any other unforeseen events beyond our control.
  • 6.2 Any additional costs incurred due to such events, including alternative travel arrangements, accommodations, food, or extra transportation, will be the traveller’s sole responsibility. The Travel Foot will assist in making alternate arrangements where possible, but the traveller must cover expenses.
  • 6.3 In an emergency, such as a medical crisis, natural disaster, or other urgent situation, our operational partners will provide necessary on-the-ground assistance. However, the costs associated with such actions (e.g., medical evacuation, helicopter rescue, alternative transportation) will fall solely on the traveller.
  • 6.4 The trekking and driving Distances / times / Altitude listed in the itinerary are approximate and may vary due to breaks for food, photography, rest, weather, road conditions, or unforeseen delays. The Travel Foot is not liable for these delays.
  • 6.5 The Travel Foot reserves the right to modify the itinerary for traveller safety, regulatory changes, weather conditions, or unforeseen logistical challenges.We will suggest alternative options if an itinerary needs to be altered due to unforeseen circumstances (e.g., bad weather, route blockages, flight/train cancellations, or landslides). However, the traveller will bear any additional costs arising from these changes.
  • 6.6 No refunds or reimbursements will be provided for unused services (such as missed flights, hotel stays, sightseeing activities, or meals) due to itinerary changes caused by external factors. 
  • 6.7 If a trip is interrupted or cut short due to personal reasons, including illness, injury, or voluntary departure, no refund or compensation will be provided for the remaining portion.
  • 6.8 Travel insurance is highly recommended for all travellers, covering trip cancellations, medical emergencies, flight disruptions, and unforeseen itinerary changes.
  • 6.9 In case of a government-imposed travel restriction, lockdown, or pandemic-related disruption, we will try rescheduling the trip. However, the traveller will bear additional costs or losses due to such regulations.

7. Travel Documents & Insurance

  • 71. Travelers must possess all necessary travel documents before departure, including a valid passport, visa, permits, and any other entry requirements per the destination’s regulations. The Travel Foot is not liable for delays, fines, trip disruptions, or denial of entry resulting from incomplete, expired, or incorrect travel documents.
  • 7.2 Comprehensive travel insurance is mandatory for all travellers participating in trips organized by The Travel Foot. The insurance policy should provide coverage for:
  • Medical emergencies (including evacuation and hospitalization)
  • Trip cancellations and interruptions
  • Personal liability
  • Lost, stolen, or damaged belongings
  • Emergency evacuations, including helicopter rescues where required
  • Delays due to unforeseen circumstances
  • 7.3 Travelers must provide proof of travel insurance before the start of the trip. Failure to do so may result in denial of participation without any refund.
  •  7.4 For high-altitude treks, adventure trips, or physically demanding activities, travellers must obtain a medical fitness certificate from a certified MBBS doctor or a registered Medical Officer. This certificate should confirm that the traveller is medically fit for strenuous activities and has no health conditions that could pose risks during the journey. Travellers with pre-existing medical conditions must disclose them before booking.
  •  7.4 The Travel Foot reserves the right to deny participation to any traveller who does not provide a valid medical fitness certificate or fails to meet the required health standards for the trip.
  • 7.5 Travel Foot will not be held responsible for any medical emergencies arising due to undisclosed medical conditions. Any medical expenses incurred during the trip will be the traveller’s sole responsibility.
  • 7.6 If a traveller fails to arrange or renew necessary travel documents or is denied entry due to personal reasons (e.g., visa rejection, immigration issues), The Travel Foot will not provide any refund or compensation for the trip.
  •  It is recommended that travellers carry both physical and digital copies of their travel documents, travel insurance policy, emergency contact details, and medical fitness certificate at all times during the trip.

8. Health & Safety

8.1 Physical Fitness & Medical Conditions:

  • Travelers must be in good health and physically capable of participating in their chosen itinerary, whether it involves adventure activities or leisure travel.
  • The traveller must disclose any pre-existing medical conditions (such as heart disease, respiratory issues, high blood pressure, recent surgeries, or other relevant conditions) before booking.
  • The Travel Foot reserves the right to refuse participation if a traveller is deemed medically unfit or poses a safety risk to themselves or others.

8.2 Adventure Travel Requirements:

  • Specific trips, such as high-altitude treks, safaris, or water-based activities, require higher endurance and stamina levels. Travellers should evaluate their fitness levels before booking.
  • A medical fitness certificate from a certified MBBS doctor or Medical Officer is mandatory for high-altitude treks and physically demanding trips.
  • If travellers experience altitude sickness, dehydration, or other medical concerns during the trip, they must inform the guide immediately and follow the recommended safety measures.
  • Participation in adventure activities is at the traveller’s own risk. The Travel Foot is not responsible for accidents, injuries, or health complications arising from negligence or failure to follow safety protocols.

8.3 Leisure Travel & General Safety:

  • For cultural, heritage, and leisure tours, travellers must maintain personal well-being and take necessary precautions (e.g., staying hydrated, wearing comfortable footwear, and dressing appropriately for the climate).
  • While visiting temples, historical sites, or religious places, travellers must respect local customs, dress codes, and guidelines.

8.4 Compliance with Safety Regulations:

  • Travelers must follow all safety instructions guides, tour leaders, and local authorities provide during the trip.
  • Compliance with local laws, COVID-19 protocols, and government travel advisories is mandatory. Any violations may result in immediate removal from the trip without a refund.
  • Helmets, life jackets, harnesses, and other safety gear must be appropriately used for activities like rafting, paragliding, trekking, and biking.
  • Travellers engaging in self-exploration beyond the planned itinerary must inform the guide and take responsibility for their safety.

8.5 Emergency Situations & Evacuation:

  • The Travel Foot and its operational partners will provide on-ground assistance in emergencies. However, the traveller will bear any expenses related to medical evacuations, helicopter rescues, hospitalization, or alternative travel arrangements.
  • Travelers are encouraged to carry a personal first aid kit and necessary medications.
  • In severe health issues, the traveller must comply with evacuation or medical advice the guide and support team provides.

8.6 Personal Safety & Risk Management:

  • Travellers are advised to be mindful of their personal belongings, including passports, money, and electronic devices. The Travel Foot is not responsible for lost, stolen, or damaged items.
  • Consumption of alcohol or drugs during adventure activities is strictly prohibited.
  • Engaging in reckless behaviour that endangers oneself or the group may result in immediate disqualification from the trip without a refund.

09. Conduct & Behaviour

09.1 Respect & Responsible Travel

  • Travellers must be respectful, cooperative, and responsible toward fellow travellers, guides, staff, and local communities.
  • Cultural sensitivity is paramount; travellers should respect local traditions, dress modestly where required, and seek permission before photographing individuals or sacred sites. Any disruptive, disrespectful, or inappropriate behaviour that negatively impacts the experience of others will not be tolerated.

09.2 Zero Tolerance for Harassment & Discrimination

  • The Travel Foot maintains a strict zero-tolerance policy against harassment, discrimination, verbal or physical abuse, bullying, or inappropriate behaviour toward guides, staff, local communities, or other travellers.
  • This includes but is not limited to racial, religious, gender-based, or sexual orientation-based discrimination or harassment.

Any such behaviour will result in immediate removal from the trip without a refund, and the traveller may be reported to local authorities if necessary. In such cases, we will work closely with local law enforcement to ensure the safety and well-being of all parties involved.

09.3 Substance Use & Intoxication

  • The consumption of illegal drugs is strictly prohibited on all trips.
  • While alcohol may be permitted in specific locations, excessive drinking leading to disruptive behaviour, health risks, or safety concerns will not be tolerated.
  • The Travel Foot reserves the right to deny participation in activities or remove a traveller from the trip if intoxication poses a danger to themselves or others.

09.4 Compliance with Local Laws & Regulations

  • Travellers must comply with all local laws and regulations of their destinations.
  • Local authorities will deal with any criminal activity, violations of local customs, or illegal actions, and The Travel Foot will not be responsible for any legal consequences the traveller may face.

09.5 Protection of Property & Environment

  • Travellers must treat lodging, transportation, and public or private property carefully.
  • Any damage, theft, or vandalism caused by a traveller will be their sole financial responsibility and necessary action may be taken.
  • Responsible tourism practices are encouraged, including minimizing waste, avoiding plastic pollution, respecting wildlife, and following eco-friendly guidelines.

09.6 Consequences of Misconduct

  • The Travel Foot reserves the right to remove any traveller from the trip immediately and without a refund if their behaviour:
  • Jeopardizes the safety and well-being of the group.
  • Causes harm or distress to fellow travellers, staff, or local communities.
  • Disrupts trip operations or violates the company’s code of conduct.
  • Involves illegal or dangerous actions.
  • The traveller will bear any expenses arising from early dismissal, including alternative transport or accommodation costs.

10.  Photography & Marketing

10.1 Use of Photos & Videos for Promotional Purposes

  • The Travel Foot may capture photographs and videos during trips for marketing, promotional, and social media purposes. These may be used on our website, brochures, advertisements, or online platforms.

10.2 Traveler Consent & Opt-Out Option

  • If a traveller does not wish to be photographed or recorded, they must inform the tour leader and our team at the trip’s start.
  • We respect privacy concerns, and any requests to exclude specific images from public use will be honoured where possible.

10.3 Traveler’s Personal Photography & Social Media Use

  • Travelers are welcome to take personal photos and videos during the trip. However, they must respect local communities, fellow travellers, and cultural sensitivities.
  • Permission should be obtained before taking close-up photos of individuals, religious sites, or restricted areas.

10.4 Third-Party Media & Content Sharing

  • Travellers who share their photos or videos with The Travel Foot (via email, social media tags, or testimonials) grant us the right to use this content for promotional purposes unless otherwise stated.
  • The Travel Foot will not sell or misuse personal images for commercial purposes beyond promotional content related to our travel experiences.

11. Governing Law & Dispute Resolution

11.1 Jurisdiction & Applicable Law

  • These Terms & Conditions shall be governed by and interpreted by the laws of the State of Uttarakhand, India.
  • Any disputes or legal matters will be subject to the exclusive jurisdiction of the courts in Uttarakhand, India.

11.2 Mediation & Dispute Resolution

  • In any dispute, both parties agree to attempt resolution through mediation before initiating any legal proceedings.
  • If mediation fails, the dispute may be escalated to arbitration in Uttarakhand, per the Arbitration and Conciliation Act, 1996.

11.3 Liability for Legal Costs

  • Any legal proceedings arising from this agreement shall be pursued at the traveller’s expense unless otherwise determined by the court or arbitrator.

11.4 Time Limit for Claims

  • Any claim or dispute must be raised in writing within 07 days of the trip’s completion. Claims beyond this timeframe may not be entertained.

11.5 Modifications & Amendments

  • The Travel Foot reserves the right to update or modify these Terms & Conditions at anytime. Any changes will be communicated via the official website or direct email to affected travelers.

 Acceptance of Terms

By booking a trip with The Travel Foot, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. You accept all associated policies and guidelines under the laws of Uttarakhand, India.
